Introduction
This Anna National Bank Online Banking Agreement and Disclosure governs your use of Online Banking. By using Anna National Bank Online Banking, you agree to all of the terms of this Agreement. Please read it
carefully, keep a copy for your records and submit your
acceptance of this agreement by clicking the Accept button at
the bottom of the screen.
Business Day Disclosure
Our business days are Monday through Friday, excluding Legal Bank Holidays as defined by the Federal Reserve. If you perform a transfer after 2:00 p.m. on a banking day, it will be processed on the next business day.
User Code and Password
Each individual who has access to Online Banking, including each individual named on joint accounts, must designate a Personal Identification Number (Password). Your Password must be a minimum of four characters up to a maximum of 8 characters. Your User Code will be assigned to you along with a temporary password. Your User Code will remain unchanged, but your Password should be changed periodically for security purposes.
Account Access
You may use your User Code and Password to: access account information, transfer funds between your accounts, and pay bills.
Charges
Anna National Bank Online access is free.
Processing
Your Payments and Transfers
You may schedule transfers to be initiated on the current business day, on a future date, or on the same date of each
month. Funds will be deducted from your account on the business day on which a transfer is to be initiated. Transfers between your accounts must be scheduled by the cut-off time of 2:00 p.m. on any business day in order for the transaction to be completed on that business day.
Recurring Transfers
Recurring transfers are those made for the same amount and are made on a weekly, bi-monthly, monthly, or other regularly scheduled basis. Once started, recurring transfers will be made automatically until you notify us to cancel the transfer.
Anna National Bank's Liability
If we do not complete a transaction to or from your checking or savings account on time or in the correct amount, we will be liable for your losses or damages. However, some exceptions apply. We will not be liable for instance if:
Through no fault of ours your account does not contain sufficient funds to make the transaction.
Circumstances beyond our control, such as fire, flood or a mechanical or electrical failure prevent the transaction and we have taken reasonable precautions to avoid those circumstances.
The money in your account is subject to uncollected funds hold, legal process, dispute or any other agreement restricting transfers.
There may be other exceptions not specifically mentioned above.
Limitation of Liabilty
Except as otherwise provided in this agreement or by law, we are not liable for any loss, injury, or damage, whether direct, indirect, special, incidental or consequential, caused by the Online Banking Service, or the use thereof or arising in any way out of the use of the Service, including by not limited to any damage to your equipment.
Periodic Statements
You will receive a monthly account statement providing information on all transfers made on your Anna National Bank accounts.
Errors and Questions
Please call 618-833-8506 or write to Anna National Bank; 201 South Main St.; Anna, IL 62906 as soon as you can if you think your statement is wrong or is you need more information about a transaction listed on your statement. We must hear from you no later than 60 days after we sent you the FIRST statement on which the error or problem appreared. You need to give us the following information:
(1) Your name and account number.
(2) Describe the error or the transfer you are unsure about, and explain as clearly as you can why you believe there is an error or why you need more information.
(3) Tell us the dollar amount of the suspected error.
We will investigate your complaint and will correct any error promptly. If we take more that 10 business days to do this, we will recredit your account for the amount you think is in error, so that you will have use of the money during the time it takes us to complete our investigation.
Disclosure of Account Information to Third Parties
When it is necessary to contract with outside third parties to perform specific services or support bank products the vendors selected are expected to adhere to the same privacy standards and applicable laws and regulations as the Bank. They must be additionally responsible for maintaining customer confidentiality.
Waivers
No waiver of the terms of this Agreement will be effective unless in writing and signed by an officer of the Bank.
Governing Law
The laws of the state of Illinois and applicable federal Laws shall govern this agreement and all transactions hereunder. Customer acknowledges that he/she has reviewed this Agreement, understands the terms and conditions set forth herein, and agrees to be bound hereby.
Amendments
We can change a term or condition of this agreement by mailing or delivering to you a written notice at least 30 days before the effective date of any such change. We do not need to provide you with any prior notice where an immediate change in the terms or conditions of this agreement is necessary to maintain or restore the security of our system or an account. If the change is made permanent, we will provide you with a notice of the change with the next regularly scheduled periodic statement we send you, or within 30 days, unless disclosure would jeopardize the security of our system or an account. Notices mailed or delivered to you under this paragraph will be considered effective if mailed to the most recent address we show for you in the Account records, or the e-mail address which you authorized to receive such notices and/or disclosures.
Indemnification
Customer, in consideration of being allowed access to the online Banking Service, agrees to indemnify and hold the Anna National Bank harmless for any losses or damages to the Bank resulting from the Customer's use of the Services, to the fullest extent allowed by applicable law.
Security Procedures
By accessing the Service, you hereby acknowledge that you will be entering a protected web site owned by the Bank, which may be used only for authorized purposes. The Bank may monitor and audit usage of the Service, and all persons are hereby notified that use of the Service constitutes consent such as monitoring and auditing. Unauthorized attempts to up-load information and/or change information on these web sites are strictly prohibited and are subject to prosecution under state and federal law. |
